By accessing Path2Hire.com or utilizing our services, you agree to the following terms.

These Terms constitute a legally binding agreement between you and Path2Hire. Please read them carefully before using our services.

Talent Marketplace & Recruitment

Terms for candidates and hiring partners

For Candidates

Honest Assessment Completion

You agree that all assessments will be completed honestly. Falsification of identity or cheating results in immediate termination of your profile.

Note: Any attempt to falsify information or cheat in assessments will result in immediate profile termination without refund.

For Hiring Partners (Agencies & Corporates)

Database Access

Access to our vetted database is subject to a Success Fee. The specific fee structure (percentage of annual salary or fixed rate) is governed by the individual Service Level Agreement (SLA) or Statement of Work (SOW) signed between the Partner and Path2Hire.

Non-Circumvention

Partners agree not to bypass Path2Hire to hire candidates introduced through our platform. If a candidate is hired within 12 months of introduction, the applicable fee remains due.

Contractual Agreements

All partnership terms are formalized through SLA or SOW documents. These documents supersede any verbal agreements or general terms mentioned here.

Corporate Solutions & HR Outsourcing (HRO)

Terms for corporate service delivery

Service Delivery

Path2Hire provides HRO and payroll services as an agent of the Client. The Client remains the legal employer unless otherwise stated in a Managed Services Agreement.

Managed Services Agreement may modify terms
Service scope defined in individual contracts

Confidentiality

Both parties agree to protect proprietary business information and trade secrets exchanged during the service period.

Contractual Basis

All Corporate Solutions are provided under specific contractual agreements. The terms of these agreements take precedence over these general terms and conditions.

Terms for training services and intellectual property

Job Seeker Training

Training Recommendations

Path2Hire suggests training modules based on assessment scores to enhance your employability and skill development.

No Employment Guarantee

While we aim for successful placement, enrollment in training does not guarantee a job offer. Success depends on multiple factors including market conditions and individual performance.

Intellectual Property

Exclusive Property

All training materials, videos, and assessment logic are the exclusive property of Path2Hire.

Prohibited Activities

Unauthorized reproduction, distribution, modification, or sharing of any training content is strictly prohibited and may result in legal action.

Legal Protection

All content is protected under copyright and intellectual property laws. Violations will be pursued to the fullest extent of the law.

Limitation of Liability

Our responsibilities and limitations

Vetting and Training Intermediary

Intermediary Role

Path2Hire is a vetting and training intermediary. We are not liable for the conduct, performance, or disputes arising between a Candidate and an Employer after a hire is made.

Financial Liability Limit

Our total liability is limited to the fees paid for the specific service in question.

No Indirect Damages

We are not liable for any indirect, incidental, or consequential damages.

Service Limitations

We do not guarantee employment outcomes or specific performance results.

Statutory Rights

Some jurisdictions do not allow the exclusion or limitation of liability, so the above limitations may not apply to you to the extent prohibited by applicable law.

Governing Law

Legal jurisdiction and dispute resolution

Legal Framework

Applicable Law

These terms are governed by the laws of India, without regard to its conflict of law principles.

Exclusive Jurisdiction

Any disputes are subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

Dispute Resolution

Parties agree to attempt amicable resolution before legal proceedings.

Notice Requirements

Legal notices must be in writing and sent to our registered office.

Time Limitation for Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the services must be commenced within one (1) year after the cause of action accrues.

Acceptance of Terms

By accessing or using the Path2Hire platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
